GENERAL TERMS AND CONDITIONS

House Of Emera registration number ESZ2698715S, address Alicante, Torrevieja, Spain (hereinafter referred to as the "Seller"), and the Customer, who places an order in the online store www.houseofemera.com and identifies themselves by entering their personal data in the order form (hereinafter referred to as the "Customer"), agree to the following terms.

1. General Terms

1.1. The online store www.houseofemera.com (hereinafter referred to as the "Online Store") is an e-commerce platform established by the Seller, through which the Seller sells and the Customer purchases the products offered by the Seller.

1.2. The parties shall be governed by Spanish law and other applicable regulations, as well as by these terms and conditions.

1.3. The Seller reserves the right to modify the content of the Online Store, the selection of available products, and these terms and conditions at any time.

2. Purchasing Process

2.1. All products listed in the Seller’s Online Store are available in stock.

2.2. If a product is not available, the Seller will contact the Customer to offer a new estimated delivery time, a replacement product of the same price and quality, or a refund. The refund will be processed promptly, but no later than 30 calendar days from the order date.

2.3. The Customer selects the desired products from the Online Store, adds them to the shopping cart, fills out the order form, and makes the payment through the available payment options.

2.4. An order confirmation and payment receipt will be sent to the email address provided by the Customer.

2.5. The Customer must provide accurate information when completing the order form, as it is necessary for order fulfillment. The Seller is not responsible for any issues arising due to incorrect or incomplete information provided by the Customer.

2.6. The order is processed once the Seller has received the order and the Customer has made the payment.

3. Order Placement

3.1. The Customer’s shopping cart is created when they add a product to the cart.

3.2. The Customer can modify the quantity of products in the cart, add new items, or remove items. To proceed with the order, the Customer must click "Order," which will redirect them to the order form.

3.3. After filling in the necessary information and submitting the order, the Customer is directed to the order confirmation and payment selection page.

3.4. House Of Emera is the responsible data processor.

3.5. For payment processing, House Of Emera transfers the necessary personal data to authorized payment processors.

3.6. Customers can pay via credit card or bank card through the Stripe payment service.

3.7. Payments are accepted in euros (€).

3.8. Payment transactions are processed by a secure payment provider.

4. Customer Right of Withdrawal

4.1. If the Customer wishes to cancel the order before the Seller processes it, they must notify the Seller as soon as possible in writing via email at houseofemera@gmail.com

4.2. If the cancellation request is received before the order is processed, the Seller will refund the payment promptly, but no later than 14 days from the date of receiving the cancellation notice. Refunds will be issued to the same bank account from which the payment was made. Due to payment processing fees, a 5% deduction may apply.

5. Return Policy

5.1. Orders are delivered via parcel lockers and couriers. For international deliveries, the package will be shipped via Packeta Ltd or a similar service provider.

5.2. Standard delivery within Spain takes approximately 3-5 business days from the date of order confirmation.

5.3. Customers will receive a notification with a tracking code when their package arrives at a parcel locker or post office.

5.4. Customers have the right to return unused and unopened products within 14 days of receiving the order. A full refund will be issued once the Seller verifies that the product has not been used or damaged.

5.5. If the Customer receives an incorrect, defective, or damaged product, they must inform the Seller immediately via email, including photo evidence.

5.6. If a replacement is preferred instead of a refund, the Seller and Customer can agree on this in writing. In such a case, the defective or incorrect product does not need to be returned, and a replacement or refund will be processed within 14 days.

5.7. The Seller is responsible for any damage or loss of the product during shipping. Once the package has been delivered to the Customer's selected parcel locker or post office, the Seller is no longer liable for any issues.

5.8. If the Customer does not collect the package within the designated time (usually 7 calendar days), it will be considered a cancellation of the order. In such cases, the Seller will refund the payment within 14 days, deducting the shipping and return costs.
